3. User Eligibility

You must be at least 18 years old and have a valid NFIP flood insurance policy to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Accounts and Access

• You may receive a secure access link to create a portal session for your claim
• Access links are single-use and expire after 7 days
• You are responsible for maintaining the confidentiality of your access credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

5. User Responsibilities

When using the Service, you agree to:

• Provide accurate, complete, and truthful information
• Submit only authentic photos and documentation of your property damage
• Not submit fraudulent or exaggerated claims
• Cooperate with claims adjusters and provide requested information
• Comply with all applicable federal and state laws

6. Prohibited Uses

You may not:

• Use the Service for any unlawful purpose or to commit fraud
• Upload malicious software or attempt to disrupt the Service
• Access or attempt to access accounts that do not belong to you
• Reverse engineer or attempt to extract source code from the Service
• Use automated tools (bots, scrapers) to access the Service
• Submit false information or documentation

7. Content and Intellectual Property

Your Content

You retain ownership of all photos, videos, and documentation you submit through the Service. By submitting content, you grant us a license to use, store, and process this content solely for the purposes of processing your claim and complying with NFIP requirements.

Our Content

All content, features, and functionality of the Service (excluding your submitted content) are owned by ClearClaims and are protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information. Please review our Privacy Policy carefully.

9. NFIP Compliance

This Service is designed to facilitate NFIP claims processing. However:

• We do not determine claim eligibility or payment amounts
• Final claim decisions are made by FEMA-approved claims adjusters and insurance carriers
• Use of this Service does not guarantee claim approval or payment
• All claims are subject to NFIP terms, conditions, and policy limits
